STEP 3 OF 3: COMPLETE LIABILITY RELEASE FORM

I agree to the following conditions:

ASSUMPTION OF LIABILITY OR RESPONSIBILITY

Michael DeYoung, DeYoung Photo Workshops LLC, Active Photo Tours, field trip assistants, and cooperating agents aim to provide every participant a safe, educational, and enjoyable experience. We act solely as agents for you regarding accommodations, special activities, and travel, by any means, and assume no liability or responsibility for A) any act, error, omission, injury, loss, delay, mishap, or damage to persons or property arising from any cause during the course of the workshop or in transit thereto or B) for losses or additional expenses due to delay or changes in the services to be provided.

RESERVE THE RIGHT

We reserve the right to change our arrangements should conditions necessitate, or to cancel any aspect of the workshop or photo tour due to exceptional circumstances. In the event that we deem it necessary to cancel the workshop or photo tour we will provide a full refund which the participants acknowledge as full and final settlement.

ELEMENT OF RISK

As there is always an element of risk in any adventure associated with the outdoors including, but not limited to, bodily injury, death, illness, loss or damage to personal property, participants must read this form carefully. This liability release will certify that the participant is physically fit and capable of participating in outdoor photography exercises in field locations, and is fully and completely aware of any associated risks created by field locations and weather.

INSURANCE

I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I have no medical or physical conditions, which could interfere with my safety in this activity, or else I am willing to assume and bear the costs of all risks that may be created, directly or indirectly, by any such condition.

CONSENT TO USE PHOTOGRAPH OF YOU

I hereby give Michael DeYoung, DeYoung Photo Workshops, LLC, Active Photo Tours and Assigns my permission to license the Content and to use the Content in any Media for any purpose (except pornographic or defamatory) which may include, among others, advertising, promotion, marketing and packaging for any product or service. I agree that the Content may be combined with other images, text, graphics, audio, audiovisual works; and may be cropped, altered or modified. I agree that I have no rights to the Content, and all rights to the Content belong to Michael DeYoung and Assigns. I acknowledge and agree that I have no further right to additional consideration or accounting, and that I will make no further claim for any reason to Michael DeYoung, DeYoung Photo Workshops, LLC, and / or Assigns. I acknowledge and agree that this release is binding upon my heirs and assigns.

ITINERARY SUBJECT TO CHANGE

Meeting times, meeting places and itinerary are subject to changes dictated by the weather, the road conditions and other imponderable variables that are part of doing outdoor, on-location, landscape or lifestyle photography.

CONSENT

BY JOINING ANY OF THE WORKSHOPS OR PHOTO TOURS ORGANIZED BY MICHAEL DEYOUNG, DEYOUNG PHOTO WORKSHOPS, LLC, OR ACTIVE PHOTO TOURS, I ACKNOWLEDGE THAT I HAVE READ THE ABOVE INFORMATION CONCERNING RESPONSIBILITY AND RELEASE MICHAEL DEYOUNG, DEYOUNG PHOTO WORKSHOPS LLC, FIELD TRIP ASSISTANTS AND ANY COOPERATING AGENT FROM ANY LIABILITY.

PARTICIPATION

MICHAEL DEYOUNG, DEYOUNG PHOTO WORKSHOPS, LLC, ACTIVE PHOTO TOURS OR HIS ASSISTANTS WILL ASSUME NO LIABILITY FOR INJURY, ILLNESS, OR LOSS OF PERSONAL PROPERTY OR EXPENSES THEREOF ASSOCIATED WITH WORKSHOP OR PHOTO TOUR PARTICIPATION.
